Probate Filing Fees in Australia by State
Probate filing fees are charged by your state's Supreme Court and scale with the value of the estate. These are separate from any solicitor fees for preparing and lodging the application.
What Probate Fees Cover
The filing fee covers the court's administrative cost of granting probate - confirming the will is valid and the executor has legal authority to administer the estate. This does not include solicitor fees, which are charged separately if you engage legal help.
Do All Estates Need Probate?
Not necessarily - smaller estates, or those where assets are held jointly (such as a jointly-owned home that passes automatically to the surviving owner), may not require probate at all. Banks and financial institutions typically have their own thresholds below which probate isn't required to release funds.
